Shop and Establishment Act (Gumasta License)

Shop and Establishment Act Registration is mandatory for all premises wherein any trade, business or profession is carried out.  Shop and Establishment Act is under state legislation, and each state has framed its own rules and regulations for the same.

Broadly, all shops, hotels, eating houses, restaurants, theatres, places of public amusement or establishment and other commercial establishments, etc. are under the Shop and Establishment Act. They have to obtain registration under the same. The Act not only regulates the working of commercial establishments but also regulated societies, charitable trusts, educational institutions etc.

Maharashtra Shops and Establishment Act

Maharashtra Shop and Establishment Act is designed to regulate the payment of wages, hours of work, terms of service, wages for holidays, leave policy, work conditions, overtime work, interval for meals and rest, prohibition for employment of children, employment of young persons or women, maternity leave and benefits thereof, opening and closing hours, closed days, weekly holiday, and other work conditions of people employed in the shop and commercial establishments.

Applicability of Maharashtra Shop and Establishment Act

Maharashtra Shop and Establishment Act is designed to regulate the payment of wages, hours of work, terms of service, wages for holidays, leave policy, work conditions, overtime work, interval for meals and rest, prohibition for employment of children, employment of young persons or women, maternity leave and benefits thereof, opening and closing hours, closed days, weekly holiday, and other work conditions of people employed in the shop and commercial establishments.

Registration under Maharashtra Shop and Establishment Act

The establishment covered under the Act must apply for registration, within 30 days from the date of commencement of establishment. The Labour Department, Government of Maharashtra governs the Shop and Establishment Act. The shop or the establishment submits the application of the registration to the local district labour officer. After the satisfaction of the application, the concerned officer will issue the Shop and Establishment Act registration certificate.

  • Establishments employing 10 or more employees need to obtain the     registration certificate (online) which will be valid for a lifetime.

  • The firms employing less than 10 workers only need to intimate about   the commencement of their shops/ establishments.

  • The Department has abolished the provisions for renewals which   needed to be done from time to time.
